b.  This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a Platform and does not require any physical or digital signatures. 

c.  This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of Platform. 

d.  For the purpose of these Terms of Use, wherever the context so requires “You” or “Customer” shall mean any natural or legal person who uses the Platform. mystartup allows the User to surf the Platform without registering on the Platform. The terms “We”, “Us”, “Our” shall mean mystartup. 

e.  Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. Use of the Platform shall be subject to the policies that are applicable to the Platform. By mere use of the Platform, You shall be contracting with mystartup and these terms and conditions including the policies constitute Your binding obligations, with mystartup. 

f.  This Platform, including all Materials present (excluding any applicable third party materials), is the property of mystartup and is copyrighted and protected by worldwide copyright laws and treaty provisions. You hereby agree to comply with all copyright laws worldwide in Your use of this Platform and to prevent any unauthorized copying of the Materials. mystartup does not grant any express or implied rights under any patents, trademarks, copyrights, or trade secret information.

This Platform, all the Materials and information/content (including but not limited to software) and services, included on or otherwise made available to you through this Platform are provided on “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the foregoing paragraph, mystartup does not warrant that:

a.  This Platform will be constantly available, or available at all; or

b.  The information on this Platform is complete, true, accurate, or non-misleading. 

12. mystartup will not be liable to you in any way or in relation to the materials of, or use of, or otherwise in connection with, the Platform. mystartup does not warrant that this Platform; information, content, Materials, product (including software) or services included on or otherwise made available to you through the Platform; their servers; or electronic communication sent from Us are free of viruses or other harmful components. 

13 Indemnity: You shall indemnify and hold harmless mystartup, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out
